1. Obligations of clients and users

In general terms, the user is obliged to comply with these general conditions, as well as to comply with the special warnings or instructions for use contained therein or on the website and to always act in accordance with the law, good customs and the requirements of good faith, using due diligence, and refraining from using the website in any way that could prevent, damage or deteriorate its normal functioning, the goods or rights of Divinos.wine, its suppliers, other users or in general. from any third party. Access and use of the portal by minors is prohibited without the express consent of their parents. Divinos.wine is not responsible for the veracity and accuracy of the data filled out by the user and therefore cannot verify their age. .

Specifically, and without implying any restriction to the previous section, during the use of the Divinos.wine website, the user undertakes to:

The client undertakes to enable the delivery of the requested order by providing a delivery address to which the requested order can be delivered within the usual delivery hours of goods. In the event of non-compliance by the client with this obligation, Divinos.wine will not have any responsibility for the delay or impossibility of delivery of the order requested by the client.

2. Right of withdrawal

If you are not satisfied, you can return your purchases made at www.divinos.wine in our own online store. To do this you must first contact our Customer Service, who will send you a return authorization that you will have to attach to the package.

The maximum period to request a return is 7 business days from receipt of the order.

The circumstances that may cause a return are the following:

a) If the product you have ordered does not satisfy you: You can return it via courier to Divinos.wine. We will refund the amount of the product but not the shipping/return costs of the product paid in the order.

b) Defective product of origin: Once Divinos.wine receives the defective product, it will be reviewed and you will be sent another one. In this case the change will always be made for the same article or reference. You will only be invoiced for the first shipment, with Tutiendadevinoonline.com being responsible for the shipping costs corresponding to the return and new shipment. If you wish to exchange for another item, the return and new shipping costs will not be assumed by Divinos.wine.

c) Product that, by mistake, does not correspond to the order: Divinos.wine will bear the costs of collecting the wrong product and delivering the product corresponding to the order placed.

d) You cannot withdraw from the purchase of products that have been ordered from Divinos.wine "ex profeso".

For all cases of withdrawal, the shipping and return costs of products will comply with the provisions of Royal Legislative Decree 1/2007 and complementary regulations.

In all cases, the products must be in perfect condition, unsealed and in their original packaging.

3. Product warranty

  In those incidents that justify the use of the guarantee, the option will be to repair, replace the item, discount or return, under the legally established terms.

  Divinos.wine will make changes or refunds provided that:

a) Prior communication is given to our Customer Service: This step is essential regardless of the reason for the return. You can do this by sending us an email to info@divinos.wine. We will tell you how you can act to return the item.

b) The item to be returned must be correctly packaged for its return. The packaging must be in perfect condition and unsealed, as should the products in it.

4. Refund of amounts paid

The refund will be made through bank transfer or if the system allows it, by the same payment method used for the purchase.

Reimbursement of purchases made by gift voucher will be made exclusively by means of a gift voucher of the same amount as that paid with said means of payment.

Divinos.wine will not refund the amount or resend any merchandise until the receipt and packaging status of the item being returned or exchanged has been verified. The price to be returned is the one that originally appeared in the order, except for transportation costs, which will only be returned if divino.wine is responsible for the reason for returning the product. Once the correct condition of the returned product has been verified, divino.wine will refund the amount within a maximum period of 15 days.

5. Applicable legislation. Submission to jurisdictions.

Sales made on www.divinos.wine are subject to Spanish legislation.

In the event that any conflict or discrepancy arises in the interpretation or application of these contractual conditions, the Courts and Tribunals that, where appropriate, will hear the matter, will be those established by the applicable legal regulations regarding competent jurisdiction, in which is served, in the case of final consumers, at the place of fulfillment of the obligation or the domicile of the purchasing party.

In the event that the purchasing party is domiciled outside of Spain, or in the case of a sale carried out by a company, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Murcia (Spain).
